Náklady na náhradní vozidlo z povinného ručení
Mnoho z Vás a Vašich známých se jistě setkalo s tím, že jste žádali po pojistiteli viníka nehody náhradu nákladů na zapůjčení náhradního vozidla po dobu opravy. Jistě jste také narazili na skutečnost, že pojistitel odečetl od půjčovného takzvané pevné náklady, které jste uspořili tím, že jste neprovozovali vlastní vozidlo. Pro výpočet takové úspory byl pojistitelem použit dříve zákon o cestovních náhradách a následně úprava základních náhrad obsažená v zákoníku práce. Výše takové úspory byla nejčastěji vypočtena na 3,70 Kč na 1 ujetý km. Je to tak ale správně?
Je mnoho společností, které se zabývají spory s pojistitelem za poškozené, kterým takto byla náhrada plnění krácena. Argumentace je obvykle shodná a vychází z rozsudku Nejvyššího soudu ČR 25 Cdo 2703/2006 ze dne 16.10.2008 (kompletní znění naleznete zde). Tento rozsudek říká, že použití právní úpravy, která se týká cestovních náhrad, při vyčíslování uspořených pevných nákladů je nepřípustné. Nejvyšší soud připouští, že skutečná škoda je opravdu dána rozdílem mezi náklady na zapůjčení náhradního vozidla a úsporou za nepoužívání vlastního vozidla, je však potřeba k výpočtu této úspory přistupovat individuálně. Na úsporu mají totiž vliv různé technické parametry, jako druh a cena pneumatik, druh a cena provozních kapalin, pořizovací cena vozidla, objem motoru a jiné, což právní úprava týkající se cestovních náhrad nezohledňuje.
V případě, že se nyní setkáte se stejným postupem pojistitele, který byl používán doposud, tedy že bude odečítat pevné náklady na provoz vozidla ve výši cca 3,70 Kč na 1 km podle cestovních náhrad, pak doporučuji takto stanovené plnění rozporovat a požádat o přehodnocení výpočtu s odvolání na rozsudek Nejvyššího soudu ČR. Co se týká skutečné výše uspořených nákladů, tak ta bohužel není jednoduše stanovitelná. Jako jediné správné vyčíslení by mohl být snad jen znalecký posudek zpracovaný ke konkrétnímu vozidlu. Věřím, že u běžného vozidla se mohou pevné náklady pohybovat do cca 2 Kč za 1 km. Doporučil bych tedy nejprve navrhnout pojistiteli částku nižší, než určil on, s tím, že pokud ji nebude akceptovat, pak si necháte na toto zpracovat znalecký posudek a náklady na něj vyúčtujete spolu s ostatními škodami. Pokud i na toto pojistitel nebude kladně reagovat, je možné se obrátit na jednu ze společností, které se zabývají těmito spory s pojistiteli.
Na závěr je možné optimisticky potvrdit skutečnost, že pojistitelé od výpočtu podle původní metodiky ustupují, čehož příkladem může být i Česká pojišťovna.

If the cast iron is coming through the enamel, it is perfectly safe to use. Just remember to season that area as you would plain uncoated, non-procelain or enamel cast iron, so it won’t rust. It is like using plain cast iron!
